Terms & Conditions

Welcome to Élevé Luxe Media. By engaging with our services, you agree to the following Terms & Conditions.

1. Services

Élevé Luxe Media provides digital marketing services including, but not limited to, social media management, brand strategy, content creation, campaign execution, and digital consulting. Services are delivered according to the package or project scope agreed upon in writing.

2. Payments

  • Deposit/Retainer: A non-refundable deposit of 50% of the total project fee (or the first month’s retainer for ongoing services) is required before work begins.

  • Balance: The remaining balance is due upon project completion and before final deliverables are released. For retainer clients, payment is due on the first of each month in advance of services.

  • Accepted Methods: Payments may be made via [insert: Stripe, PayPal, bank transfer, credit/debit card, etc.].

  • Late Payments: Payments not received within 7 days of the due date will incur a 5% late fee per week until paid in full. Work may be paused until payment is received.

  • Milestone Projects: For larger projects, payment may be broken into installments: 50% deposit, 25% at milestone approval, and 25% before final delivery.

  • Refunds: All deposits and retainers are non-refundable. Refunds are not issued for services already rendered or completed deliverables.

  • Suspension of Services: Élevé Luxe Media reserves the right to suspend or terminate services for accounts with overdue balances beyond 14 days.

3. Deliverables & Timelines

We strive to meet all agreed deadlines. Delays caused by the client (e.g., late submission of content or feedback) may affect timelines.

4. Revisions

Élevé Luxe Media is committed to delivering work that aligns with the client’s vision. Clients are entitled to unlimited revisions up until the project deadline or delivery date, provided that:

  • Revision requests remain within the original scope of work agreed upon.

  • Requests for revisions after the agreed deadline may incur additional charges.

  • Significant changes outside the original scope (e.g., shifting strategy, adding new deliverables, or changing the project direction) will be considered a new project and quoted separately.

5. Intellectual Property

  • Content created by Élevé Luxe Media will be transferred to the client upon full payment.

  • Élevé Luxe Media retains the right to showcase work for portfolio and marketing purposes.

  • Client-provided materials remain the client’s property; client affirms they have rights to all materials supplied.

6. Confidentiality

Both parties agree to keep all sensitive business information confidential.

7. Limitation of Liability

Élevé Luxe Media is not responsible for:

  • Platform algorithm changes

  • Technical outages on third-party platforms

  • Results outside our reasonable control

8. Termination

Either party may terminate the agreement with written notice. Client is responsible for payment of all services rendered up to termination date.

9. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. By engaging Élevé Luxe Media, the client agrees that any disputes arising under these Terms & Conditions shall be subject to the exclusive jurisdiction of the state and federal courts located in Virginia, USA.
